Ubermorgen.com was never and will never be connected to etoy. We reject to add credibility to pseudo activism, fake-art-loops, ruthless provocation and radical-chic to impress naive news hunters & art nerds.



etoy - twisted but subtle and playful - is investigating the edge of technological and cultural realities and seeks long term impact. The ubermorgen methods are incompatible with everything that etoy does.



Hans Bernhard (etoy.PRESS-SPEAKER 96/97) has left etoy in August 1998 and founded ubermorgen.com in 1999. He has not contributed to etoy since 1998, did not help to defend the etoy.com domain in 1999 (TOYWAR) and does not own any rights or interests in etoy today. Hans Bernhard and his wife Elisabeth Haas hide behind fake (simply fact check!) and the notion of SHOCK MARKETING in order to play their dull games and to attach themselves to the success of etoy today.





All etoy-companies and anti-etoy-trademarks registered by Hans Bernhard as well as false credits in the ubermorgen.com CV and catalogues (i.e. TOYWAR, etoy.SHOWS after 1998 and now MISSION ETERNITY) are simple attempts to claim credit for work others do, to obtain financial benefit (grants) and to enrich the ubermorgen portfolio with etoy.WORK. At the same time Hans Bernhard plays the victim and uses his so called "etoy.HOLDING" to send out threats to our partners to torpedo ongoing etoy.PROJECTS. He regularly insults etoy.MEMBERS, calls etoy "a proto-fascist" organization (http://www.ubermorgen.com/2006/pdfs/etoy.pdf) and used etoy for commercial advertisement. The ubermorgen people disregard ethical conduct and basic rules of fairness.

While this seems to be great fun for uebermorgen.com and non-involved rubbernecks, it is inacceptable for 20 etoy.AGENTS working on sensitive projects at the intersection of technology, education, art and cultural politics. Operations like TOYWAR, etoy.DAY-CARE or MISSION ETERNITY are expensive, complex and enter sensitive zones of human existence. They may be discussed controversial and require the resources and goodwill of people and organizations of different social backgrounds. It is impossible to convince partners such as high profile museums, government officials, corporate sponsors, NGOs, universities, religious dignitaries, social organizations responsible for the security of children, politicians, cemetery administrators, judges etc. to support (or just permit) fragile etoy.PROJECTS, if a former member directly links etoy with Nazi imagery and breaches of law. Especially if uncritical articles (i.e. on rhizome.org) quote Hans Bernhard to be responsible for etoy.STRATEGY, trademarks and finances - even 8 years after official discharge.

Whether you care about the law or not: it is extremely obstructive for etoy and its partners to deal with conflicts and illegal actions conducted in the name of etoy. The uebermorgen game works as long naive journalists, bloggers, and net.art curators such as Inke Arms or Mario Hergueta ignore or even glorify / amplify the damaging side effects of shock marketing. There is a massive lack of critical thinking. If uebermorgen.com decided to build fame on provoked conflicts involving etoy Hans Bernhard & his blind supporters must prepare for trouble. etoy is fed up with being abused for simple minded martyr-actions, trying to provoke low profile TOYWAR II (the only way hans can reconnect himself to etoy today).



etoy has subtle and difficult tasks to manage - i.e. the digital encapsulation of a 83 old test pilot and 10'000 children for MISSION ETERNITY or the integration of human mortal remains into a CARGO CONTAINER SARCOPHAGUS. This demands all our attention and energy. Our work is not compatible with a brainless legal mess. If ubermorgen.com depends on this kind of promotion and ignores etoy's rights we are forced to hand over this problem to a court - the last and very expensive solution to sort out disputes. We are not naive and think all problems can be solved with funny activism: even TOYWAR required 10 lawyers on our side.



Meanwhile we count on intelligent people who see the tragedy behind this kind of war and take position for fair co-existence of different concepts of art and activism. Sane ubermorgen partners, friends and supporters could prevent further conflict and bring them to terms. War is dirty and will hurt all of us. Whatever the reasons for the uebermorgen attacks on etoy, we are not willing to accept the hypocritical abuse of our name.

We are not against ubermorgen.com as long as they do their shock marketing art under their own name and let us do our thing. Hans Bernhard has left etoy in 1998 and gets credits for the time he was part of the crew. Ubermorgen.com and Elisabeth Haas were never connected to etoy. PERIOD.

AS ARTISTS, WE RELY ON A CRITICAL AUDIENCE THAT CAN IDENTIFY THE UEBERMORGEN GAME WITH etoy AS IMPERTINENT AND DESTRUCTIVE. PLEASE CONSIDER THIS WHEN CHEERING. THIS SAD LITTLE WAR ONLY LASTS AS LONG AS PEOPLE LIKE YOU IGNORE THE FACTS.
